Economics professor at UC Irvine, David Agrawal, said he believes Propositions 41 and 42 were in part a reaction to Prop. 40. He said both propositions have the potential to void Prop. 40 if they pass, but that would ultimately be up to the courts. “If they are in conflict, then the one with the more votes would presumably be the one that would carry the day. But again, this is something that probably the courts will eventually need to weigh in on,” said Agrawal.
